Behind the scenes: A release three weeks in the making


LAHORE: 
The federal and provincial governments, and the intelligence agencies, had been working since February 21 to ensure Raymond Davis’ release through the Qisas and Diyat laws,The Express Tribune has learnt.
Three weeks ago, the Interior Ministry sought the particulars including the addresses of the family members of the men Davis shot so it could contact them and prepare their passports, sources said.
The Punjab government, meanwhile, used police and other officials to put pressure on the heirs of the deceased to accept payment of blood money in return for pardoning Davis, the sources said.
The sources said that PML-N chief Nawaz Sharif had assured US Senator John Kerry when he visited Pakistan in mid-February that even if the federal government did not produce documents in the Lahore High Court showing Davis to have diplomatic immunity, the Punjab government would help get the CIA contractor pardoned through the payment of Diyat.
The sources said that the federal and provincial governments and the country’s intelligence agencies all agreed on one thing: that Davis must  be released via the courts through the payment of Diyat to minimise the public uproar at his release.
They said that they had made a secret agreement on February 21 to facilitate the release of Davis in this manner. Around this time, the US authorities also began preparing to fulfil the formalities regarding compensation and visas, the sources said.
Neighbours of the families say that their houses had been locked for the last two days and they had not been seen. Lawyer Asad Manzoor Butt, who represented them at the previous hearing, said he had been trying to contact them since March 14 but their phones were off.
When Punjab Chief Minister Shahbaz Sharif was asked by a reporter in London yesterday about the provincial government allegedly kidnapping the family, Sharif denied this and told the reporter to ask the federal government.
Meanwhile, according to Daily Express, Davis travelled on a special US plane from Lahore airbase to Bagram and the Intelligence Bureau and police were not in the loop. He was flown out without an exit stamp on his passport.
The Allama Iqbal Airport’s radar system received a short message on Wednesday that a special aircraft would touch down at the PAF base. Airport officials were told nothing else.
Quoting sources, Daily Express said that under instructions from sensitive agencies, the Punjab chief secretary, home secretary, inspector general of police and inspector general of prisons crafted the exit plan on March 15.
The sources added that the families of Faizan and Faheem had been shifted to Islamabad via the Motorway. They would first be taken to Dubai since the issuance of US visas would take time.

Raymond Davis released:


LAHORE: US national Raymond Davis, the accused in the double-murder case in Lahore has been released, Punjab Law Minister Rana Sanaullah confirmed on Wednesday. The Punjab government claims it played no part in the release of Davis.
Sanaullah added that the families of the victims in the Lahore shooting pardoned Davis.
Initial reports from sources state that Davis has been flown to London.
Earlier, a sessions court judge in Lahore had formally indicted US national Davis.
According to Express 24/7 correspondent Muhammad Rizwan, in the hearing that took place at Kot Lakhpat jail, Davis’ counsel Zahid Hussain Bokhari tried to stall the ruling saying he did not trust the investigation process. However, the judge ignored his statement and formally indicted the accused.
Davis was only indicted for double murder and not for other charges like espionage.
Davis was arrested after he killed two Pakistanis, Faizan and Faheem, in Lahore’s Mozang area, on January 27, 2011.
In the last hearing, Davis had refused to receive any documents or sign the charge-sheet. His attorneys had said they had received it on his behalf and had asked the court to include it in its orders. According to sources they had sought further time to prepare for the trial.
Charge-sheet
Earlier, on February 15, 2011, the police had submitted a 25-page charge-sheet in the court declaring that Davis had murdered two people and was not acting in self-defence.
The charge-sheet stated that Davis’ self-defence plea was false as it was intentional murder. It read that the guns recovered from the possession of the deceased were not loaded and they had also not pointed a gun at Davis. Fingerprints were found on the pistols’ triggers and on bodies of the deceased and tests show that the bullets remained in the magazines of their guns, not the chambers.
The charge-sheet also stated that the police had recovered a GPS tracker, mobile phones, wireless sets, a survival kit and photographs from Davis’ car. The accused, it says, is uncooperative with the police during investigation.
The charge-sheet also contained the statements of 47 witnesses, who have said that Davis did not shoot the men in self-defence. They also said that Davis had shot directly at the two boys and kept shooting even when one of them tried to flee.
Immunity
The Lahore High Court (LHC) ruled on Monday that the matter of immunity for Davis will be decided by the trial court, and disposed of all petitions challenging his diplomatic status in Pakistan.

US drone kills five militants in Miranshah: Official

A US drone strike in Datta Khel on Wednesday killed at least five militants, security officials said, as the covert campaign steps up in the border region.

The strike took place in Datta Khel town, 25 kilometres (15 miles) west of Miranshah, the main town in North Waziristan tribal district, which borders Afghanistan and is a stronghold of al Qaeda-linked Taliban militants.
“A US drone fired three missiles at a militant compound in Datta Khel. Five militants were killed in this attack,” one intelligence official told AFP.
A security official in northwestern Peshawar city told AFP a militant compound had been targeted.
“We are not clear about the identities of the militants,” he said.
The US drones, which operate with the tacit consent of Islamabad but fuel anti-US sentiment throughout the country, have mounted increasing attacks lately, pummeling the area believed to hide key Taliban-linked militants.
Missile attacks doubled in the area last year as the covert campaignwas stepped up, with more than 100 drone strikes killing over 670 people in 2010 compared with 45 strikes that killed 420 in 2009, according to an AFP tally.
The last strike was on Monday when at least three militants were killed, according to security officials, in a US missile strike on a vehicle in a tribal town near the Afghan border.
Most have been concentrated in North Waziristan, where the United States wants the Pakistan military to launch a ground offensive as soon as possible.
Despite pressure from Washington, Pakistan has stalled on launching such an offensive in North Waziristan, saying its troops are already overstretched.
Wednesday’s attack was launched hours before a Pakistani court is scheduled to resume the hearing of a CIA contractor in a double murder case that has ruptured relations between the United States and its wary nuclear-armed ally.
The hearing in the murder case against American Raymond Davis is due to take place in Kot Lakhpat jail in Lahore, where he is being held, as US authorities continue to press for his release on grounds of diplomatic immunity.
The United States does not confirm the drone attacks, but its military and the Central Intelligence Agency (CIA) operating in Afghanistan are the only forces that deploy them in the region.
The missile strikes cause widespread resentment among the Pakistani public, who see military action on their soil as a breach of national sovereignty.
But Islamabad tacitly cooperates with the bombing campaign, which US officials say has severely weakened al Qaeda’s leadership and killed high-value targets including the former Pakistani Taliban chief Baitullah Mehsud.
US officials say Pakistan-based militants are helping to escalate the war in Afghanistan, putting up a deadly fight against 140,000 US-led Nato troops there and seeking to bring down the Western-backed government in Kabul.

SC seeks ECP, Nadra’s comments on dubious voters



ISLAMABAD: The Supreme Court on Tuesday sought categorical comments within 10 days from the Election Commission of Pakistan (ECP) and the National Database and Registration Authority (Nadra) on 37.8 million dubious voters registered during 2007.

A two-member bench, comprising Chief Justice Iftikhar Muhammad Chaudhry and Justice Ghulam Rabbani, issued the directive on a plea filed by one Muabashir Lucman through his counsel Ali Raza.

The counsel prayed that such fake voters’ lists should be immediately removed, as there should not be any conflict between the details of voters’ lists compiled by the Nadra and the ECP.

In its first phase of preparations for the new electoral rolls, the ECP had found that over 37 million voters registered in 2007 were dubious as they were either duplicated, multipliplicated or bogus entries.

CM grills cops over poor performance



LAHORE – Mian Muhammad Shahbaz Sharif has expressed his dissatisfaction over the performance of the Punjab police while chairng a meeting here on Tuesday to review the law and order situation in the province. 
“I am not interested in statistics but will be satisfied with the efficiency of the police force if the public also expressed their satisfaction,” the chief minister told senior police officers attending the meeting. 
Shahbaz said his government was promoting good governance and merit in the province, adding that the police had been purged of political interference. “After creation of a very conducive environment, it is now the responsibility of police to show results,” he said, adding that honest police officers were posted in the province but the expected change at the lower level had not been witnessed. 
He told the meeting that not only the salaries of police were raised substantially, the force has also been equipped with modern tools, so they should now perform efficiently. He warned that there should not be any hurdle in the provision of justice to the aggrieved at police stations and no negligence will be tolerated in this regard.
He reminded senior police cops attending the meeting that elimination of crime and protection of life and property of citizens was the duty of police and it should spare no effort to fulfill this obligation.

LAHOREPunjab Chief Minister Muhammad Shahbaz Sharif has said that elimination of crime and protection of life and property of citizens is the duty of police and it should spare no effort for this purpose.

He said that good governance and merit has been promoted in the province while police has been purged of political interference and now it is its responsibility to show results. He said that provincial metropolis should be made a role model with regard to Thana culture, elimination of corruption, strict accountability, monitoring and other aspects and later this model should be replicated in all districts of the province. He directed that meetings should be held twice a month on regular basis in all districts for reviewing and improving law and order and elected representatives should also attend these meetings.

He was presiding over a high level meeting regarding law and order, here today. Members National Assembly Hamza Shahbaz Sharif, Afzal Khokhar, Bilal Yasin, Malik Riaz, Senator Pervaiz Rashid, Members Provincial Assembly Kh. Salman Rafiq, Mian Nauman, Dr. Saeed Elahi, Inspector General Police, Home Secretary, Commissioner, Capital City Police Officer Lahore and concerned officers were present. Law and order situation in the provincial metropolis was reviewed in detail in the meeting. The Chief Minister said that maintenance of law and order in the top priority of the government and for this purpose not only salaries of police were raised substantially but it was also equipped with modern facilities so that it could perform its duties efficiently. He said that there should not be any hurdle in the provision of justice to the aggrieved at police stations as no negligence will be tolerated in this regard. He said that besides transformation of Thana culture, police stations should also be made the hub of redressing the grievances of the poor and the common man. He said that police should serve as a symbol of terror for the hooligans and anti-social elements. He directed that short and long term planning should be made for improving performance of Police in the provincial metropolis and measures should be taken for community policing, evolving a comprehensive system of monitoring and ridding police force of black sheep. He said that honest police officers were posted in the province but the expected change at the lower level has not been witnessed. He said that police stations are of fundamental importance in the provision of justice to the common man and Thana culture can only be changed if DSPs and SHOs perform their responsibilities with commitment and dedication. He said that if the police at the lower level perform its duties properly, most of the problems of the people would be resolved and it is possible only if senior police officer evolve a comprehensive system of monitoring at every level. He said that he is not interested in statistics but will be satisfied with the efficiency of police if the public also expressed its satisfaction.

The Chief Minister further said that programme of recruitment of Inspectors and DSPs in police through Public Service Commission should be given the final shape as soon as possible. He said that demands of justice should be upheld in the investigation of cases and honest and professional officers and staff should be posted in investigation wing. He said that holding of meetings twice a month at district level regarding law and order should be ensured. Commending the effective operation against the criminals involved in the cases of kidnapping for ransom and other heinous crimes in Rahim Yar Khan, the Chief Minister directed that the operation should be continued till complete eradication of criminal elements. Elected representatives also gave their proposals in the meeting for the improvement of law and order in the province. Capital City Police Officer Muhammad Aslam Tareen apprised the meeting of the measures taken for elimination of crimes in the provincial metropolis.

PML-N opposes ISI chief extension











ISLAMABAD: 
The PML-N on Tuesday opposed the extension given by the government to in-service Inter-Services Intelligence (ISI) chief Major General Shuja Pasha.

In an interview to Express News programme Pakistan Bolta Hai with Munizae Jahangir, PML-N leader Chaudhry Nisar said the ISI chief is already on an extension, and the PML-N was not consulted on a second extension.
Lieutenant General Pasha, director general of the military’s ISI agency, is due to retire this month but will remain in office, perhaps for two more years, theDawn newspaper reported.
Pasha, a former head of military operations for the army, was appointed head of the ISI in September 2008, at a time when US officials questioned the reliability of the spy agency in the campaign against militancy.
Discussing the issue of the NAB chairman case, Nisar  said that his party would wait for the detailed decision of the Supreme Court on the case before replying to the letter written to him by President Asif Ali Zardari. However, he added that there were several questions that he also wanted to ask President Zardari on the issue.
Earlier, Prime Minister Syed Yousaf Raza Gilani’s spokesman had refuted  Nisar’s claim of not receiving a letter sent by the President about the NAB chief.
The spokesman claims the letter was received by Chaudhry Nisar’s guard at the opposition leader’s residence in Rawalpindi on March 11. The letter was written in connection with consultation on the appointment of NAB chairman after the Supreme Court ruled Deedar Hussain Shah’s appointment illegal.
Referring to the PML-N’s role in the current setup, Nisar said his party would not adopt any unconstitutional or un-parliamentary path but the PML-N was in a position to give the government a tough time.
